It seems like a desperate measure. They would do better to negotiate with their authors than try to browbeat them like this.
Lining up the dots: Sarnoff of Random House (http://bookseller-association.blogspot.com/2009/12/deal-is-not-sealed-and-we-are-handing.html) has played a big part in promoting the settlement; it clearly still rankles with Random House that they had to back down over the RosettaBooks case (http://www.rosettabooks.com/pages/legal.html), or they wouldn't be trying to fight that battle all over again; the GBS agreement (http://www.gillianspraggs.com/gbs/GBS_survival_aid.html#issues) effectively awards publishers a share in the digital rights of all the unreverted books they've ever published.
I have been amazed at what the publishers have let Google slip past them in the rest of the settlement agreement.
